Axolt operates an SMS notification programme to keep customers informed of important transactional events and operational updates. The following terms govern your participation in this programme.

By providing your mobile phone number to Axolt and opting in to SMS communications, you consent to receive text messages as described above. Consent to receive SMS messages is not a condition of purchasing any product or service from Axolt.

Supported carriers include major US carriers; however, carrier support may vary. Axolt is not liable for delayed or undelivered messages.

Privacy & Data

Your use of the Services is also governed by Axolt's Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of information as described in the Privacy Policy.

Key commitments regarding your personal data:

• Mobile phone numbers are not sold, rented, or shared with third parties for marketing purposes.
• Message frequency for SMS communications may vary depending on order, shipment, service, or account activity.
• Standard message and data rates may apply when receiving SMS notifications.

Axolt processes personal data in accordance with applicable data protection legislation, including the UK GDPR, Canada's PIPEDA, and other relevant regional requirements where applicable.

Limitation of Liability

To the maximum extent permitted by applicable law, Axolt and its directors, employees, agents, affiliates, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with:

• Your access to, use of, or inability to use the Services.
• Any conduct or content of any third party on or through the Services.
• Unauthorised access to or alteration of your data or transmissions.

In no event shall Axolt's aggregate liability exceed the greater of (a) the total fees paid by you to Axolt in the twelve months preceding the claim, or (b) one hundred US dollars (USD $100).

Termination

Axolt reserves the right to suspend or terminate your access to the Services at any time, with or without cause, with or without notice, effective immediately, if we reasonably believe you have violated these Terms or applicable laws.

Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property ownership, disclaimers, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. Axolt is registered in the United Kingdom and Canada.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise required by mandatory consumer protection legislation in your jurisdiction.
